§ 6-10. Compliance with design standards.

  • (a)

    General. The planning commission in its discretion may waive certain portions of the design standards where in their opinion it is felt no adverse affect to the community shall occur and where such action would not be in conflict with other ordinances.

    (b)

    Standards subject to waiver. The following design standards may be waived:

    (1)

    The maximum percent of grade for streets and roads may be exceeded, subject to prior approval from the Virginia Department of Highways and Transportation (VDH&T), that state maintenance funds will be approved. (The City of Norton will request this approval from VDH&T.)

    (2)

    The paving width of streets and roads may be reduced, subject to prior approval from VDH&T that state maintenance funds will be approved. (The City of Norton will request approval from VDH&T.)

    (3)

    The requirement for sidewalks and curb and gutter may be eliminated subject to the approval of the planning commission.

    (4)

    The leveling area required at intersections may exceed the two (2) percent rate, subject to prior approval from VDH&T that state maintenance funds will be approved. (The City of Norton will request this approval from VDH&T.)

    (5)

    The requirement for underground utilities may be waived if topographical or ground rock conditions would make such a requirement cost prohibitive to the subdivider.
