§ 5-7. Review of final plat.

(a)

The planning commission shall act on the final plat within sixty (60) days of submission. If no action is taken within the sixty-day period the subdivider may petition the circuit court as allowed in section 15.1-475 of the Code of Virginia.

(b)

The commission shall set forth in writing whether of approval, modification, or disapproval. If approval of the preliminary plat has been made within the last six (6) months, and has not been altered or changed in any way, then this approval is also valid for the final plat. In case of modification or disapproval, it shall give its reasons therefor to the subdivider who may revise the plat accordingly for resubmission. The commission's approval of the plat shall be certified by the chairman and attested to by the secretary, by so indicating on the plat.

(c)

The plat shall not be approved until the subdivider has complied with the general requirements and minimum standards of design in accordance with this chapter.
