§ 6-1. General improvements.

  • (a)

    Conformance with applicable rules and regulations. In addition to the requirements established herein, all subdivision plats shall comply with the following laws, rules and regulations:

    (1)

    Title 15.1 chapter 11 of the Code of Virginia (1950) as amended.

    (2)

    City of Norton Zoning Ordinance and Comprehensive Plan.

    (3)

    The Building Officials and Code Administration (BOCA) Code as administered by the City of Norton.

    (4)

    The City of Norton Soil and Erosion Control Ordinance.

    (5)

    The special requirements of these regulations and any rules of the health department and/or appropriate state agencies.

    (6)

    Plat approval may be withheld if a subdivision is not in conformity with the above guides or policy and purposes of these regulations established in section 1-1 of these regulations.

    (b)

    Self imposed restrictions. If the owner places restrictions on any of the land contained in the subdivision greater than those required by the zoning ordinance or these regulations, such restrictions or reference thereto may be indicated on the plat.

    (c)

    Plats straddling municipal boundaries. Whenever access to the subdivision is required across land in another local government, the planning commission may request assurance from the city attorney that access is legally established, and from the city manager that the access road is adequately improved or that a performance bond has been executed.

    (d)

    Monuments. Reinforced concrete monuments four (4) inches in diameter or square, three (3) feet long, with a flat top, shall be at all street corners, at all points where the street line intersects the exterior boundaries of the subdivision, and at right angle points, and points of curve in each street. The top of the monument shall have an indented cross and shall be set flush with finished grade. All other lot corners shall be marked with iron stakes not less than five-eighths ( 5/8 ) inch in diameter and eighteen (18) inches long and driven to be flush with finished grade.

    (e)

    Character of the land. Land which the planning commission finds to be unsuitable for subdivision or development due to flooding, improper drainage, steep slopes, rock formations, adverse earth formations or topography, utility easements, or other features which will reasonably be harmful to the safety, health, and general welfare of the present or future inhabitants of the subdivision and/or its surrounding areas, shall not be subdivided or developed unless adequate methods are formulated by the developer and approved by the planning commission, upon recommendation of the city manager, to solve the problems created by the unsuitable land conditions. Such land shall be set aside for uses as shall not involve such a danger.

    (f)

    Subdivision name. The proposed name of the subdivision shall not duplicate, or too closely approximate phonetically, the name of any other subdivision in the area covered by these regulations. The planning commission shall have the final authority to approve the name of the subdivision which shall be determined at preliminary plat approval.
