§ 5-10. Maintenance of improvements.

  • (a)

    The applicant shall be required to maintain all improvements on the individual subdivided lots and provide for snow removal and other maintenance to insure that the streets remain passable to all users until acceptance of said improvements by the planning commission and city council. If there are any certificates of occupancy on a street not dedicated to the local government, the local government may on twelve (12) hours' notice plow the street or effect emergency repairs and charge same to applicant.

    (b)

    The applicant shall be required to file a maintenance/defect bond with the planning commission prior to dedication of subdivision improvements in an amount considered adequate by the city manager, but not to exceed the cost of the bituminous concrete used in the project, and in a form satisfactory to the city attorney, in order to assure the satisfactory condition of all the required dedicated improvements for a period of one (1) year after the date of their acceptance by the planning commission and dedication of same to the local government. If a performance/payment bond was issued and will remain valid for this one- year period a maintenance/defect bond will not be required.
