§ 2-34. Subdivision.

  • (a)

    The division of a parcel of land into three (3) or more lots or parcels of less than five (5) acres, each for the purpose, whether immediate or future, of transfer of ownership or building development.

    (b)

    Where a new street is involved, any division of a parcel of land, regardless of the size of the parcel.

    (c)

    The improvement of one (1) or more parcels of land for residential, commercial or industrial structure or groups of structures involving the division or allocation of land for the opening, widening or extension of any street, except private streets serving industrial structures.

    (d)

    The division or allocation of land as open spaces for common use by owners, occupants or leaseholders.

    (e)

    The division or allocation of land as easements for the extension and maintenance of public sewer, water, storm drainage or other public facilities.

    (f)

    The term includes resubdivision and, when appropriate to the context, shall relate to the process of subdividing or to the land subdivided.
